Welcome to PestGuard. These Terms of Use ("Terms") govern your access to and use of the PestGuard website and related services (collectively, the "Service"). PestGuard is a free service designed to assist homeowners in connecting with local pest control and related service providers. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

PestGuard provides an informational platform and referral service that allows users to request quotes and be connected with independent contractors and service providers. We do not employ these providers, perform pest control or related services ourselves, or guarantee any work performed by third parties. All contractors and providers listed or referred through our Service are independent entities. It is your responsibility as the homeowner to verify that any contractor you hire holds the necessary licenses, insurance, and qualifications required for the work being performed in your jurisdiction.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to transmit any harmful, offensive, or illegal content; to impersonate any person or entity; to collect or harvest personal information of other users without consent; to interfere with or disrupt the Service or servers; or to attempt to gain unauthorized access to any part of the Service or related systems. We do not guarantee the accuracy, completeness, or usefulness of any content on the Service, and we are not responsible for the conduct, quality, or outcome of any services provided by third parties. All persons depicted in photos or videos on the Service may be actors or models and are not necessarily contractors listed on PestGuard. Your use of the Service and any reliance on information or referrals is at your sole risk.

5. Limitation of Liability

To the fullest extent permitted by applicable law, PestGuard and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or any dealings with service providers obtained through the Service. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim, or one hundred dollars, whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless PestGuard and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any third-party right, or any dispute between you and a service provider or other user. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.

The Service and its content, features, and functionality (including but not limited to text, graphics, logos, icons, and software) are owned by PestGuard or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content without our prior written consent. You may view and print a reasonable amount of content for personal, non-commercial use only.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services, including those of independent service providers. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites or services. These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
